SC junks plea challenging ‘logical discrepancy’ category in West Bengal SIR

New Delhi

The Supreme Court of India on Monday declined to entertain a plea challenging the ‘logical discrepancy’ category in the Special Intensive Revision (SIR) of electoral rolls in West Bengal.

A bench headed by Chief Justice Surya Kant, along with Justices Joymalya Bagchi and Vipul Pancholi, also questioned the maintainability of the petition filed directly under Article 32 of the Constitution.

“You want us to decide who is your father, your mother and your brother under an Article 32 petition? Go to the Election Commission,” the bench remarked.

The top court was hearing a petition filed by Md Zimfarhad Nowaj, who sought directions declaring the ‘logical discrepancy’ criterion adopted during the SIR of electoral rolls in the state as ultra vires Articles 14 and 324 of the Constitution.

The petitioner had also challenged a notice issued to him by the Election Commission of India pursuant to the disputed ‘logical discrepancy’ category.
