SC to hear petitions against 'revenge' demolitions

New Delhi

The Supreme Court will hear the petition of Jamiat Ulama-i-Hind against the demolition drive being carried out by the Municipal Corporation against the alleged encroachers in Delhi’s Jahangirpuri area after clashes had erupted during a religious procession being taken out on Hanuman Jayanti.

A SC bench to hear the case comprises Justices L. Nageswara Rao and B.R. Gavai while the petitioner is represented by senior Congress leader and advocate Kapil Sibal.

Earlier another petitioner that questioned the legality of demolitions  in several BJP-ruled states, including Madhya Pradesh’s Khargone, following the riots was also filed in Supreme Court.

The bench, headed by Chief Justice N.V. Ramana and comprising Justices Krishna Murari and Hima Kohli, had decided to list it with the Jahangirpuri matter on Thursday.

Expressing his happiness on the Court order, Arshad Madani, leader of the Jamiat Ulama-i-Hind said he had faith in the court and would abide by its order. 

On Wednesday, the court had given a stay on the MCD’s demolition drive in Jahangirpuri.

The petition filed by the Arshad madani led Jamiat Ulema-i-Hind says, “A number of ministers and legislators, including the Chief Minister and the Home Minister of the state of Madhya Pradesh, have made statements advocating such acts and especially threatened the minority groups with destruction of their homes and commercial properties in case of riots. Resorting to such measures/ actions is clearly against our constitutional ethos and the criminal justice system,"
