The driver of businessman Shivam Mishra on Wednesday claimed that he was behind the wheel of the Lamborghini that rammed into an autorickshaw, a Bullet motorcycle and later a pole near Jhula Park Crossing in Kanpur, leaving one person injured.

The driver, identified as Mohan, said Mishra was seated beside him at the time of the accident and allegedly suffered a seizure moments before the crash.

“Yes, he was sitting next to me. Suddenly his hands and legs started shaking and he fell on me. I was driving the car. I was present at the spot when the accident happened. A bouncer pulled me out of the vehicle,” Mohan told reporters.

Shivam Mishra’s lawyer, Narendra Kumar Yadav, said the driver has submitted an affidavit taking responsibility for the incident.

“In this case, the accused has given an affidavit stating that he is the permanent driver of the vehicle and that he was driving on the day of the incident. He has remained in constant touch with the police,” Yadav said.

The lawyer also said that the injured person and the complainant have reached a settlement. According to him, compensation has been paid and the complainant has expressed unwillingness to pursue further action.

“The injured has received compensation and has written that he does not wish to proceed with the case. He himself has identified the driver. The police are conducting their investigation, and the court’s order is awaited,” Yadav added.

However, police officials earlier stated that their investigation, including examination of CCTV footage, indicates that Shivam Mishra was driving the vehicle at the time of the crash.

“When Shivam’s name appears in our investigation, it means we are satisfied that he was driving. We have CCTV footage, and his name has been included in the FIR,” a police official said.

The case has been registered under relevant provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, including Sections 281, 125(a), 125(b) and 324(4). The investigation has been assigned to Sub-Inspector Dinesh Kumar.

Deputy Commissioner of Police (Central Kanpur) Atul Kumar Srivastava confirmed that no arrests have been made so far.

The accident occurred on Sunday afternoon when the luxury vehicle collided with multiple objects. Eyewitnesses claimed the car was being driven at high speed, and alleged that bouncers accompanying the occupants removed a person from the vehicle immediately after the crash. Police said the probe is ongoing.
