The Juvenile Justice Board has denied bail to two minors accused in a fatal clash during Holi in southwest Delhi’s Uttam Nagar, observing that their release could disturb public peace and undermine confidence in the justice system.
The decision was passed by presiding officer Chitranshi Arora while hearing bail applications filed by the accused, who are classified as Children in Conflict with Law (CCLs).
The case pertains to a March 4 incident in which a 26-year-old man, Tarun, died after sustaining injuries in a clash between two neighbouring families belonging to different communities. The altercation reportedly began after a water balloon accidentally hit a woman, escalating tensions.
In its April 9 order, the board noted that releasing the minors at this stage could aggravate the situation and pose risks to both public order and the accused themselves.
“The premature release of the CCLs… is likely to aggravate the prevailing situation, disturb public peace, and undermine public confidence in the justice delivery system,” the board observed.
It also cited submissions by the investigating officer, who said the incident had triggered communal tension in the area, affecting social harmony.
The board emphasised that continued custody of the minors is not punitive but aimed at ensuring their safety, rehabilitation and psychological well-being, in line with the Juvenile Justice Act, 2015.
It further noted that releasing the minors could expose them to physical and emotional harm, including risks of retaliation or intimidation amid prevailing tensions.
While acknowledging concerns regarding disruption to their education, the board held that such considerations cannot outweigh the need for protection and rehabilitation when credible risks are involved.
“The principle of the best interest of the child remains the guiding star,” the board said, adding that continued protective custody would provide a structured environment for counselling, education and medical care.
The board concluded that granting bail at this stage would defeat the ends of justice under the rehabilitative framework of the law, and accordingly rejected the plea.

The incident had earlier sparked protests in the area, during which vehicles linked to some accused were set on fire. Police have arrested multiple individuals in connection with the case.
